Job Description and Duties

THIS POSITION MAY BE ELIGIBLE FOR A HYBRID WORK SCHEDULE. THE AMOUNT OF TELEWORK IS AT THE DISCRETION OF THE DEPARTMENT AND IS SUBJECT TO CHANGE AS BUSINESS NEEDS ARISE.

Under the general direction of the Assistant Director/ Chief Counsel, the Attorney III (Staff Attorney) performs sensitive and complex legal work for the Employment Training Panel (ETP). This role focuses on providing legal guidance on ethics, personnel matters, legal research, and the review of competitive procurement procedures for grants and contracts.

The incumbent is responsible for drafting proposed legislation, regulations, rulemaking documents, and internal policies to ensure all business conducted by the Panel complies with applicable laws and administrative requirements. The Attorney III provides essential legal ethics advice to Panel Members, management, and staff regarding the Bagley-Keene Open Meeting Act, and the Political Reform Act, and guides the preparation of responses the Public Records Act requests.

A significant portion of this role involves providing legal guidance on human resources matters, including employee discipline, terminations, reasonable accommodations, leaves of absence, and performance management. The Attorney III advises management on Equal Employment Opportunity (EEO) laws, conducts an overseas workplace harassment and discrimination investigations, and represents the department in administrative proceedings before entities like the State Personnel Board (SPB), the Department of Fair Employment and Housing (DFEH/CRD), and the EEOC.

Furthermore, the staff Attorney reviews grants and contracts, provides legal support throughout the multi-stage procurement process, and drafts necessary legal instruments, forms, and templates. The incumbent acts as a legal liaison to managers and staff, ensuring that program monitoring needs are met and that document requests are thorough and legally defensible.

This position may be headquartered at any of ETP office locations (Sacramento, San Francisco, North Hollywood, or San Diego) and may be eligible for telework under ETP's telework policy. California government code section 14200 requires employees to reside in California to telecommute employees are required to report to their headquarters office as travel expenses needed to and from the assigned headquarters are the responsibility of the employee.

Position located at 1100 J Street, Downtown Sacramento located next to the Cathedral of Blessed Sacrament, near light rail.

Effective July 1, 2025, specific Bargaining Units and associated Excluded State employees are subject to a salary reduction between 2% - 4.62% in exchange for hours in the Personal Leave Program 2025 (PLP 2025) per month. Criminal Offender Record Information (CORI) - Title 11, section 703 (d) of the California Code of Regulations requires criminal record checks of all personnel who have access to Criminal Offender Record Information (CORI). Pursuant to this requirement, applicants for this position will be required to submit fingerprints to the Department of Justice and be cleared before hiring. In accordance with CORI procedures, clearance shall be maintained while employed in a CORI-designated position. Additionally, the position routinely works with sensitive and confidential issues and/or materials and is expected to maintain the privacy and confidentiality of documents and topics pertaining to individuals or to sensitive program matters at all times.

Conflict of Interest (COI) - This position is subject to Conflict-of-Interest Regulations. The incumbent is required to submit a Statement of Economic Interests (Form 700) within 30 days of assuming office, annually by April 1, and within 30 days of leaving office.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  • Experience performing complex legal research, statutory interpretation, and drafting proposed legislation, regulations, and organizational policies.
  • Knowledge of and experience applying California personnel and employment laws, including civil service rules, employee discipline, performance management, and reasonable accommodations.
  • Experience conducting or overseeing sensitive workplace harassment and discrimination investigations, writing legally defensible findings, and providing sound EEO guidance.
  • Experience representing a state agency or department in administrative proceedings before control bodies such as the State Personnel Board (SPB), Civil Rights Department (CRD/DFEH), or EEOC.
  • Knowledge of public contracting laws and experience providing legal oversight throughout a competitive procurement process, including drafting and reviewing complex grants, contracts, and templates.
  • Expertise in state governance and transparency laws, specifically advising on the Bagley-Keene Open Meeting Act, the Political Reform Act, and responding to Public Records Act (PRA) requests.
  • The ability to work both independently on high level legal projects and collaboratively with executive leadership, program managers, and external partners.
  • Excellent written and verbal communication skills, with a demonstrated ability to deliver clear, actionable legal advice and ethics training to non-legal staff and management.
