Attorney III
Job Description and Duties
Under general direction of the Chief Counsel in the Legal Unit of the Department of Industrial Relations, Occupational Safety and Health Appeals Board (OSHAB or Board) the Attorney III in the Legal Unit of the OSHAB will serve as legal counsel to the Board and will provide legal opinions on matters involving appeals of Administrative Law Judges orders and/or decisions. The Attorney will review the records and research the applicable law and then recommend the party’s or parties’ appeal be approved or denied as appropriate. The position will also prepare background information to present to the Board in order for the Members to be fully informed when resolving parties’ appeals. The incumbent will also prepare for and represent the Board in Superior Court cases.

Working Conditions
The position is located at the Department of Industrial Relations, Occupational Safety and Health Appeals Board, Sacramento Office. The building is located at 2520 Venture Oaks Way, Suite 300, Sacramento, CA 95833.
The incumbent will have a private office with natural and artificial lighting in an air-conditioned building with elevator access. Incumbent may work in an office or home/remote office setting.
Standard work hours are 8:00 a.m. to 5:00 p.m. The incumbent works 40 hours per week.
Special Requirements
Must possess active membership in good standing in the California State Bar.

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
Knowledge of: Legal research methods and performing research; legal principles and their application; scope and character of California statutory law and of the provisions of the California Constitution; principles of administrative and constitution law; trial and hearing procedure; and rules of evidence; court procedures, administrative law and the conduct of proceedings before administrative bodies; legal terms and forms in common use, statutory and case law literature and authorities; and provisions of laws and Government Code sections administered or enforced.
