Lead Enforcement Attorney
Job Description and Duties
The San Francisco Bay Conservation and Development Commission (BCDC) is seeking a seasoned Lead Enforcement Attorney. Under the general direction of the General Counsel, the Lead Enforcement and Compliance Attorney spends a significant amount of their workday working closely with BCDC’s Enforcement and Compliance Manager, along with the enforcement analysts and compliance officers to implement and support the Commission’s enforcement and compliance strategy, resolve current and past Bay-related permit violations, and develop and implement a proactive compliance program.
The Lead Enforcement Attorney spends also performs the full range of legal work on matters related to the functions and operations of the Commission including sensitive and complex legal work in connection with permitting, planning, and administration of the McAteer-Petris Act, the Suisun Marsh Preservation Act, the San Francisco Bay Plan, the Commission’s regulations, and other State and federal laws and regulations and other duties as assigned by the Chief Counsel.

Working Conditions
- Work in San Francisco office as defined by BCDC Telework Agreement. The current Telework Agreement provides for hybrid work, with two days in the office per week, subject to change. Flexible hours considered.
- Work in a stationary position (such as sitting or standing) for long periods of time using a laptop, keyboard and video display terminal
- Make site visits, inspections, and attend meetings.
- Required to maintain a valid Defensive Driver’s license if operation of a state vehicle is needed to perform work.
Desirable Qualifications
In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
- Conducting administrative hearings or presenting matters to administrative or legislative bodies; litigation experience; knowledge of rules of evidence and procedure
- Knowledge of administrative law; general principles of land use or environmental law and experience in their practical application; legal research methods.
- Defending or prosecuting administrative or judicial enforcement actions; negotiating consent decrees, administrative orders, and settlement agreements; assisting responsible parties with permit compliance and in implementing the terms of administrative or judicial orders or settlements.
- Knowledge of the statutes, including Government Code and Public Resources Code sections, and regulations administered and enforced by the Commission;
- Act in lead capacity to Legal and Enforcement staff and interface with attorneys from the State Attorneys General office oversee litigation as directed.
- Present the staff’s position at administrative enforcement hearings and respond effectively to evidence submitted by and arguments made by alleged violators or their counsel;
- Develop strategies for effective resolution of enforcement actions; negotiate with permittees and/or their counsel effectively and in a professional manner;
- Analyze legal principles and precedents and apply them to difficult and complex legal and administrative problems;
- Communicate effectively; work cooperatively with a variety of individuals and organizations and maintain the confidence and respect of others; and
- Handle multiple high-profile priorities; communicate well verbally and in writing; and work effectively under pressure.
- Collaborate with diverse individuals internally and externally seeking effective resolutions.
