Associate Attorney - Health Care and General Privacy Counseling #20005

REQUIREMENTS
Seeking a privacy associate who can assist in advising clients as they develop products and services; draft and update privacy policies, procedures, training, notifications, forms of consent, and related documents; and provide other general privacy counseling. The ideal candidate will have a solid understanding of the following:

1. Health information privacy (including human subjects research); Federal (HIPAA) and state (CMIA, Washington My Health My Data Act, Nevada SB 370) health care privacy laws;
2. Consumer privacy;
3. Other federal privacy laws, such as GLBA, FCRA, COPPA, and the FTC Act;
4. Comprehensive state privacy laws, such as the CCPA;
5. International privacy laws and regimes, such as the EU’s GDPR;
6. General technology and data flows.

Candidates should also have:

1. Experience drafting privacy policies, negotiating privacy-related contracts and data processing agreements (BAAs, DPAs, DUAs), providing product counseling, and conducting privacy compliance assessments;
2. Experience responding to and drafting notifications for privacy and data security incidents;
3. Experience with adtech (desirable but not essential);
4. Superior academic credentials;
5. Excellent oral, written, and interpersonal skills;
6. Strong professional references;
7. California bar membership or eligibility to take the next available exam is required.
