Summary
The Clerk III is responsible for processing and maintaining all criminal and civil legal instruments and records for the Justice of the Peace. This individual will process all requests for defensive driving and deferred disposition accurately process incoming mail determine and collect appropriate fees and fines and create process and maintain legal documents. The Clerk III will have daily contact with the public local law enforcement agencies attorneys and other county departments.
Essential Duties and Responsibilities
To perform this job successfully an individual must be able to perform each essential duty satisfactorily and can distinguish between civil criminal and juvenile documents for processing. Duties include the following:
CRIMINAL FILE MANAGEMENT:
- Prepare files for new criminal filings.
- Prepare and process all requests for defensive driving deferred disposition community service and payment plans.
- Process all appropriate orders signed by the Judge and disburse appropriately.
- Monitor all defensive driving and deferred disposition cases for compliance.
- Receive documents and appropriate fees from defendants public law enforcement officers or through the mail and process accordingly.
- Accept pleas from defendants and schedule hearings and trials.
- Analyze documents and determine proper process (precepts warrants subpoenas writs etc.) and issue accordingly.
- Complete appropriate process by verifying the accuracy of data to be entered in computer court files a timely manner.
PRE-FILING CRIMINAL MANAGEMENT:
- File and assign examining trial number on Felony and Class A/B Misdemeanor complaints prior to indictment or information including warrants for arrest.
POST-COURT CRIMINAL FILE MANAGEMENT:
- Prepare all legal documents (Judgments Dismissals etc.) pursuant to judges findings under the supervision of the Court Coordinator.
JUVENILE PROCEEDINGS - FAILURE TO ATTEND SCHOOL (TRUANCY):
- Assign secured case numbers to new cases and enter verified data into the computer.
- Prepare case file for Court ensuring that all associated papers received are included in the file. Issue summons to parents and child.
CIVIL FILE MANAGEMENT:
- Prepare files for new civil filings.
- Prepare and process all civil documents received from the public or attorneys.
- Create and process citation service documents.
- Prepare orders associated with Evictions and Small Claims.
- Prepare orders for mediation.
- Schedule hearing and maintain dockets.
- Prepare various writs including execution and possession.
- Prepare and file occupational driver licenses.
- Works closely with Constables office to ensure accurate and timely service of citations.
PROVIDE SERVICE TO PUBLIC DIRECTLY OR INDIRECTLY BY:
- Greeting and determining service needs of public attorneys etc.
- Providing information to the public concerning office procedures.
- Calculating and explaining charges.
- Receiving payment from the public and making change.
- Keeping records of transactions.
- Generate copies of legal documents and distribute them to appropriate agencies or the public.
- Assist the public in searching records electronically and manually.
FILE DOCUMENTS AND PROCESS MAIL BY:
- Gathering materials to be filed from departments and employees.
- Stamping date and time of receipt on incoming mail.
- Reading incoming material to determine essential information such as content or title for distribution to appropriate clerk or department.
- Sorting mail according to destination and type.
- Re-addressing undeliverable mail.
- Folding letters and inserting them in envelopes.
- Separating outgoing mail from in-house.
- Typing and indexing information on file folders.
- Determining where documents will be filed and placing documents in files.
- Locating and removing documents from files upon request.
- Recording documents removed and retrieving those not returned.
- Assisting other office personnel.
ADDITIONAL DUTIES:
- Receive and place telephone calls.
- Type from rough drafts; write and type routine letters and memorandums.
- Perform simple bookkeeping tasks.
- Attend meetings scheduled by the Computer Service Department as directed by the Court Coordinator.
- Attending yearly continuing education seminars.
- Performance of any other responsibilities to maintain the operation of the office without interruption.
- Attendance is an essential function of the job.

Mandatory Qualifications
EDUCATION and/or EXPERIENCE
High School Diploma or GED equivalent required; two (2) years experience in general office procedures and direct contact with the public; ability to navigate and use general functions of Microsoft Word Microsoft Excel and Microsoft Outlook is required; basic computer literacy required; basic accounting procedures; experience with criminal/civil case filing procedures and familiarization with legal documents; or any equivalent combination of experience and training which provides the required knowledge skills and abilities.
Desired Minimum Qualifications
LANGUAGE SKILLS
Ability to read and interpret documents such as safety rules operating and maintenance instructions and procedure manuals. Ability to write routine reports and correspondence. Ability to speak effectively before groups of customers or employees of the organization. Ability to speak Spanish preferred but not required.
MATHEMATICAL SKILLS
Ability to calculate figures and amounts such as discounts interest commissions proportions percentages area circumference and volume. Ability to apply concepts of basic algebra and geometry.
REASONING ABILITY
Ability to apply commonsense understanding to carry out instructions furnished in written oral or diagram form. Ability to deal with problems involving several concrete variables in standardized situations.
