Job Description and Duties

The Division of Medi-Cal Fraud and Elder Abuse’s (DMFEA’s) Civil Section investigates, litigates and resolves allegations of unlawful conduct and actions resulting in the defrauding, or causing the defrauding, of California’s Medicaid program, Medi-Cal, by medical providers, drug and device manufacturers, laboratories, managed care plans and numerous other entities. DMFEA’s Civil Section has recovered hundreds of millions of dollars over the preceding 12 years, most the result of actions filed under California’s False Claims Act (FCA).


This DMFEA Supervising Deputy Attorney General job posting is for a Civil Section supervisor who will carry their own adjusted case load while leading, organizing, and directing a team of attorneys, paralegals, and others in the investigation, litigation and resolution of fraud cases. This includes casework involving work before state and federal courts, while interacting with DMFEA’s auditing staff and otherwise engaging on behalf of DMFEA with public stakeholders and with DMFEA’s state and federal agency partners. The job also requires periodic assessments of legislative amendments and other policy proposals in DMFEA’s purview; conducting quarterly case reviews; handling general administrative tasks; participating in the selection process for staff; organizing and providing ongoing training for legal and investigative staff; and evaluating and responding as appropriate to the performance of supervised staff, including Deputy Attorneys General, Legal Analysts and Legal Secretaries.


The job further requires close work with counterparts in other states and federal attorneys in USDOJ and various USAOs, sometimes under the auspices of the National Association of Medicaid Fraud Control Units (NAMFCU).


Working Conditions

This is a hybrid position under current DOJ telework policy that is subject to modification. The position provides the opportunity to work remotely or in-office most days, but at least one day per week (or more) of in-office attendance is required. Travel and additional in-person attendance is required for court appearances, meetings or other operational needs.

  • This position is located in the Division of Medi-Cal Fraud and Elder Abuse, Civil Prosecutions Section in San Diego.

  • The Deputy Attorney General classifications qualify for a “Hire Above Minimum" (HAM) salary (Hiring Above Minimum Policy).

    The starting salary for each classification will be:

    • Deputy Attorney General Supervisor (8 years): $14,655

    New to State candidates in the DAG series will be hired at the starting HAM salary of the classifications.

Applicants should be experienced civil attorneys who can work both independently and as the leader of a team of attorneys, legal analysts and legal secretaries, and can engage with and work effectively with Investigative Auditors in DMFEA’s Civil Section, as well as fellow Civil Section SDAGs, in the investigation and prosecution of cases alleging fraud at the expense of Medi-Cal, the overwhelming majority of which are brought under the California False Claims Act, and may involve multiple other states and the federal government under their respective FCAs; possess strong oral and written communication skills and a strong knowledge of the California and federal FCAs and healthcare fraud, civil procedure and practice, and rules of evidence; exhibit judgment, discretion, integrity, and initiative; exhibit exceptional tact in interacting with others, including excellent listening skills, patience, self-composure, and the ability to interact effectively across disciplines, with other state and federal government agencies, and with the public; be able to lead and motivate others by positive example, perform tasks under stressful conditions, be flexible, and adeptly handle challenging situations; and possess knowledge of bargaining unit Memoranda of Understanding, civil service laws and rules, and disciplinary processes.
